
Within the business environment
there permanently are a wide variety of conflicts. Solving
them is vital to the companies for conflicts involve a waste
of time and resources, which hinders the companies’
development and delays their growth process.
In order to provide companies with an additional tool to
seek a viable and effective solution to their controversies,
the Ecuadorian-American Chamber of Commerce created its
Arbitration and Mediation Center (AMC) in May 2000. Since
then, AMC has expediently and efficiently handled a large
number of mediations and arbitrations in various fields,
achieving positive results.
By using Alternative Dispute Resolutions Methods, such as
arbitration and mediation, we intend to foster a culture
of compromise within our society. In this environment agreements
are reached through direct negotiations between the parties
in conflict, or by presenting the issue to an Arbitration
Tribunal made up of renown and honorable experts in various
fields.
Mediation is a process through which the parties, assisted
by a third neutral party called the mediator, seek a voluntary
extrajudicial and definite agreement on the settleable matter,
to conclude the conflict. The mediator will intercede in
an effort to find formulas of approximation and mutual consent
between the parties.
On the other hand, under arbitration and by signing an arbitration
clause, the parties submit themselves to the decision of
an Arbitration Court appointed by the parties from AMC arbitrator
rosters. The arbitration decision has the same enforcement
power of final judgments.
